Bill to reinstate the death penalty in Iowa, SSB 3085

This bill imposes the death penalty for murdering a law enforcement officer, but don’t let the narrowness fool you.  Once the state spends millions to create a death row, the temptation to use it for other offenses will be strong.  We cannot let this happen in Iowa!
The measure passed out of the subcommittee and is being considered by the whole Senate Judiciary Committee.  Please contact the members of this committee, with special attention to any member who happens to be your senator.  This bill hasn’t gained much traction in the past, but we must always be on the alert.
I will keep you posted on other relevant legislation – the Reform Alliance is pushing its probation reform bill again and I will let you know the numbers on this. There may also be a bill to eliminate court costs for juveniles that is coming from the Coalition for Debt Free Justice.
Our next  Tuesdays with IJAN session will occur on Tuesday, February 13, at 7:30 PM via Zoom (please note the later time.)  The topic will be the current effort to amend the 13th Amendment t the Constitution.  It currently reads as follows:

Section 1. Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.

Section 2. Congress shall have power to enforce this article by appropriate legislation.[1]

The key phrase to look at is “except as punishment for a crime.”  This enables jurisdictions to treat imprisoned people as the virtual property of the state, rather than as independent human beings.  Currently many people feel that this enables much of the abuse that goes on in prisons.   The reform movement wants to eliminate that phrase from the amendment.
